Rental Agreement and Liability Waiver

It is the responsibility of the person or organization hiring this inflatable equipment to ensure that all possible precautions are taken to avoid injury to people or damage to the inflatable. Please ensure that the following Safety Instructions are followed.

Safety Instructions

  1. NO food, drink or chewing gum on or around the Inflatable. This will avoid a choking risk and keep the unit clean. (Please note if the Inflatable is collected in a dirty condition then the person hiring it will incur a cleaning charge,
  2. shoes, glasses, jewelry, and badges MUST be removed before using the inflatable to avoid injury to peoples using the equipment and harm to the Inflatable
  3. NO party poppers, colored streamers or silly string to be used either on or near the Inflatable. (Please note these products will cause damage to the Inflatable that cannot be repaired)
  4. NO smoking on or around the Inflatable
  5. NO barbeques around the Inflatable
  6. NO Climbing, hanging or sitting on walls is dangerous and must not be allowed
  7. A responsible Adult must supervise the inflatable at all times. Always ensure that the Inflatable is not overcrowded, and limit numbers according to the age size of Children using it. Try to avoid large and small children from using it at the same time
  8. Ensure Children are not pushing, colliding, fighting or behaving in a manner likely to injure o cause distress to others.
  9. IF THERE IS STRONG WIND YOU MUST EVACUATE the bounce house and turn it off! Wind can cause catastrophic accidents or damage. If a staff member calls and informs you wind conditions are high and to turn off the bounce house you must comply.
  10. No pets, toys or sharp instruments on the inflatable at anytime
  11. Do not allow anyone to bounce on the front safety step as this is dangerous
  12. Do not allow anyone to be on the inflatable equipment during inflation or deflation as this IS DANGEROUS.
  13. Please ensure that Children are not attempting somersaults and are clothed appropriately and that nothing can fall out of their pockets,
  14. In the event that the blower stops working, please ensure all users get off the inflatable immediately and calmly. Check your breaker(s) and make sure the blower tube or deflator tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, switch the blower off at the mains, then switch it back on again 1 or 2 minutes later, and it should restart. If it does not, inform us immediately at 775 434 9932
  15. THE MOST important rule: do Not let children play on the inflatable without Adult supervision. Adult supervision is necessary to enforce these rules for safe operation of the Inflatable.

Liability Disclaimer

  1. This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear accepted)
  2. Customer assumes all responsibility for injuries to persons or damages to property, and agrees to release and hold fantasy face painting HMF Enterprises LLC for any and all claims, of whatsoever nature, arising out of use of the rental equipment while in his/her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, Customer hereby agrees to a limit on any damages claimed by Customer to the total paid to HMF Enterprises LLC for the rental.
  3. Customer agrees to company right to enter premises of customer at anytime to repossess said equipment.
  4. Customer agrees to reimburse Bounce House for Less for all attorney fees, an amount not less than 50% of all sums due, court cost and expenses incurred by HMF Enterprises LLC for Less to enforce collection or to preserve or enforce rights under this contract.
  5. Customer agrees not to loan, sublet or otherwise depose of equipment or use it at any other location.
  6. Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.
  7. If the inflatable equipment is lost, stolen, or damaged beyond repair, the renter agrees to pay $1000.00. $1800 if also provided a Generator.
  8. Customer agrees to ensure that all users (and users' guardians) of the rental equipment sign liability waivers.

THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED

The person(s) or organization renting this Equipment from HMF Enterprises LLC will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever.

Waiver

I have voluntarily elected to allow my child(ren) to participate in playing on bounce house(s), and I fully understand that this involves jumping on air fulfilled entertainment toy(s) and that there are health and safety risks associated with this type of activity. I, therefore, assume all risk of injury and/or death associated with this even and I will not hold the event organizers, sponsor, and anyone affiliated with them for any circumstances of the event.

I hereby confirm that my child(ren) are in good physical condition and do not suffer from any disabilities or physical conditions that places me or others at risk or otherwise should prohibit their participation in this even.

I hereby waive and release, indemnify, hold harmless and forever discharge you, the owners of this bounce house.

I understand that the activities that they will participate in on the date the house(s) is/are used are inherently dangerous and participation may cause harm or grievous injuries, including bodily injury, damage to personal property and/or death. I, on help of myself, my spouse, heirs, executors, administrators, representatives, successors, assigns and next of kin, waive all claims for damages, injuries and death sustained to me or my property that I may have against the aforementioned Released Parties to such activity.

By this WAIVER AND RELEASE, I assume any risk, and take full responsibility and warranty of any and all claims of personal injury and death or damages to, but not limited to my use of the Released Parties’ facilities and/or engaging in the Release Parties’ activities or other activities on and near the Release Parties’ premises on the date the house(s) are used.

This WAIVER AND RELASE contains the full and complete agreement between the parties, the items are contractual and not merely a recital, and supersedes any and all prior written or oral agreements and representations between the Parties concerning the activities and the WAIVER AND RELEASE. Any additional changes in this WAIVER AND RELEASE shall be valid only if set forth in writing and signed by all the Parties. Furthermore, this WAIVER AND RELEASE is binding upon the undersigned and his/her respective spouse, heirs, next of kin, executors, administrators, representatives, successors and assigned. This WAIVER AND RELEASE shall be subject to the laws of the State of Oklahoma. The provisions of this WAIVER AND RELEASE will remain in issue and in full force and effect even after termination of the Parties’ activities.

I acknowledge that I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE and its contents. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this WAIVER AND RELEASE voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me AND RELEASE of all liability to the full extent of the law. I am 18 years of age or Older and mentally competent to enter into this waiver.

Acknowledgement

By submitting my name, I acknowledge that I have read the above agreement and fully understand and accept the conditions as above. I am aware that while in my care I am fully responsible for the inflatable and will pay for any loss or damages that may occur.
